1. Description of Services & Limitation of Role

Serv-U Hub provides an on-demand technology platform that connects vehicle owners and motorists ("Users") in need of roadside assistance, towing, battery, or mechanical support with third-party independent roadside service professionals ("Providers").

YOU ACKNOWLEDGE AND AGREE THAT SERV-U HUB IS A TECHNOLOGY PLATFORM AND DOES NOT PROVIDE TOWING, ROADSIDE ASSISTANCE, OR MECHANICAL SERVICES DIRECTLY.

We do not own, operate, or maintain service vehicles, tow trucks, or automotive repair equipment. All roadside services requested through the Platform are performed entirely by independent third-party Providers who are not employees, agents, or joint-ventures of Serv-U Hub.

2. Eligibility & Account Registration

• Age Requirement: You must be at least 18 years of age and possess the legal authority to enter into a binding agreement to use the Platform.
• Account Accuracy: When you create an account, you must provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• Account Security: You agree to notify us immediately at support@joinservuhub.net upon suspecting any unauthorized access or breach of your account security.

3. Dispatches, Pricing, and Payments

• Quotes and Fees: Prices displayed on the Platform for roadside dispatches are estimated based on the information provided by the User (e.g., location, vehicle type, service needed). Final charges may vary based on actual on-scene conditions (e.g., severe weather, extended winch times, or additional parts needed).
• Payment Authorization: By requesting service, you authorize Serv-U Hub and its third-party payment processor Stripe connect to charge your designated credit card, debit card, or electronic payment method for the agreed amount upon dispatch confirmation or job completion. All payments are securely processed through our third-party payment processor and will not be stored on the Serv-U Hub platform. Contact Stripe Connect for any payment issues.
• Cancellation Policy: Users may cancel a service request without penalty before providers physically move and dispatch. Cancellations made after a Provider has physically accepted and departed toward the User’s location will be subject to a non-refundable "Hook-up" or "Dispatch" fee to compensate the Provider.

4. User Conduct & On-Scene Responsibilities

When utilizing the Platform and interacting with third-party Providers, Users agree to:

• Provide accurate geographic coordinates, vehicle descriptions, and clear safety contexts.
• Ensure that they or an authorized representative remain with the vehicle at the designated safe location until the Provider arrives, unless instructed otherwise by law enforcement or safety officials.
• Maintain a respectful, safe, and cooperative environment for the responding Provider. Serv-U Hub reserves the right to terminate platform access for any abusive, threatening, or illegal behavior toward Providers.

5. Intellectual Property Rights

The Platform, including its user interface, code, graphics, branding, logos, website design, text, software, and the domain joinservuhub.net are the exclusive property of Serv-U Hub and are protected by United States and international copyright, trademark, and trade secret laws.

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform strictly for personal or internal business operations. You may not:

• Copy, modify, reverse-engineer, decompile, or create derivative works of the Platform.
• Use any data-mining, scrapers, robots, or similar data-gathering methods on the Platform.
• Bypass or attempt to exploit security measures built into our application or website infrastructure.

6. App Store & Device Terms

If you downloaded our application from the Apple App Store, Google Play Store, or access our web-version via a mobile browser, you acknowledge that these Terms are solely between you and Serv-U Hub, not the app store operators (Apple, Inc. or Google, LLC). Your use of the application must comply with the respective App Store Terms of Service. Serv-U Hub is solely responsible for providing application maintenance and support services.

7. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, SERV-U HUB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SAFETY, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE PLATFORM WILL OPERATE UNINTERRUPTED, SECURELY, OR ERROR-FREE. WE MAKE NO GUARANTEES REGARDING THE AVAILABILITY, ARRIVAL TIME, QUALITY, COMPETENCE, OR SAFETY OF THE INDEPENDENT THIRD-PARTY PROVIDERS DISPATCHED THROUGH THE PLATFORM. ROAD CONDITIONS, TRAFFIC, AND ENVIRONMENT INHERENTLY IMPACT ROADSIDE ASSISTANCE, AND SERV-U HUB IS NOT LIABLE FOR DISPATCH DELAYS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SERV-U HUB, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, LOSS OF PROFITS, LOSS OF DATA, VEHICLE DAMAGE, PERSONAL INJURY, OR DEATH ARISING OUT OF:

• YOUR USE OF OR INABILITY TO ACCESS THE PLATFORM.
• THE CONDUCT, ACTS, OMISSIONS, NEGLIGENCE, OR WILLFUL MISCONDUCT OF ANY THIRD-PARTY PROVIDER ENGAGED VIA THE PLATFORM.
• ANY PHYSICAL DAMAGE CAUSED TO YOUR VEHICLE, CAR CONTENTS, OR PROPERTY DURING TOWING, JUMP-STARTS, TIRE CHANGES, OR LOCKOUT SERVICES.

IN ALL EVENTS, SERV-U HUB'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO SERV-U HUB FOR THE SPECIFIC SERVICE REQUEST GIVING RISE TO THE LIABILITY.

9. Dispute Resolution & Class Action Waiver

• Informal Resolution: In the event of a dispute, you agree to first contact us at claims@joinservuhub.net to attempt an amicable, informal resolution.
• Binding Arbitration: If an informal resolution cannot be reached within thirty (30) days, all disputes, controversies, or claims arising out of or relating to these Terms or the Platform shall be settled by binding, individual arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules.
• Class Action Waiver: YOU AGREE THAT ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR COLLECTIVE PROCEEDING.

10. Governing Law

These Terms, your use of the Platform, and any disputes arising therefrom shall be governed by, interpreted, and enforced in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles.

11. Modifications to the Terms

Serv-U Hub reserves the right to modify, amend, or update these Terms at any time. When updates are made, we will change the "Last Updated" date at the top of this document. If a change is material, we will provide a prominent notification within the app or email registered Users. Continued use of the Platform following the posting of modifications indicates your explicit acceptance of the revised Terms.
